COMMUNIST PARTY OF PAKISTAN VERSUS FEDERATION OF PAKISTAN AND OTHERS

APPLICATION FOR FIXATION OF THE AFORESAID CMA AND CONSTITUTIONAL PETITION ON 1ST OF FEBRUARY, 2012 WITH THE CRL.O.P.6/2012 IN SUO MOTO CASE NO.4/2010 ETC. (CONTEMPT PROCEEDINGS AGAINST YOUSAF RAZA GILLANI, PRIME MINISTER OF PAKISTAN).

Respectfully Sheweth:-

1.       That on the 19th of January, 2012 the Special Bench of the Supreme Court heard the CRL.O.P.6/2012 IN SUO MOTO CASE NO.4/2010 Etc against PM Gilani and as the PM Gilani and his counsel Barrister Aitzaz Ahsan sticks to immunity plea for President Zardari and in their point of view the real issue is immunity and not contempt and so the proceedings were adjourned for 1-2-2011 to see whether the President Zardari has the immunity under Article 248 of the Constitution in NRO cases or not.

2.       That the applicant/petitioner aforesaid constitutional petition is also identical and raises identical points of law concerning Article 248 that as to what extent the President enjoys immunity and the petitioner has also sought the interpretation of Art 248 in its true perspective from the Apex Court.

3.       It is, therefore, graciously requested that the aforesaid CMA along with the Constitutional Petition may kindly be clubbed and fixed for hearing on 1-2-2012 with the CRL.O.P.6/2012 IN SUO MOTO CASE NO.4/2010 Etc in the interest of justice.
