In Islamic Republic of Pakistan, the Generals are above the law even if they abrogate and subvert the Constitution or commit an act of High Treason under Article 6 of the Constitution of Pakistan, 1973 says the Communist Party of Pakistan (CPP) and its Chairman Engineer Jameel Ahmad Malik in a policy statement of his party.
Communist Party and its Chairman strongly criticized and reacted on the Supreme Court (SC) ordered of Wednesday for the removal of Ex-Chief of Army Staff General Pervez Musharraf’s name from the Exit Control List (ECL) and allowing him to travel abroad for medical treatment.
Engineer Jameel said that the Apex Court and the Prime Minister of Pakistan both in collaboration with each other had badly failed to implement the Article 6 of the Constitution as they both had facilitated General Musharraf to leave the country now and this shows that neither the SC nor the Prime Minister has obeyed to their oaths which they have taken under Constitution of Pakistan, 1973.
The five-member larger bench of the top court headed by Chief Justice Anwar Zaheer Jamali, Mr. Justice Mian Saqib Nisar, Mr. Justice Amir Hani Muslim, Mr. Justice Iqbal Hameedur Rahman and Mr. Justice Khilji Arif Hussain heard the case and in its short order dismissed the appeal. “For reasons recorded separately, the [federal government’s] appeal has been dismissed,” the order said.
However, the order will not preclude the federal government and special court’s proceedings against him under Article 6 from passing any appropriate legal order for regulating his custody or movement, it said.
“If Prime Minister Nawaz Sharif and Interior Minister Chaudhry Nisar Ali Khan are not in league with the Supreme Court verdict” then the government should not remove General Musharraf’s name from the ECL and the law should take its own course but we think that “The government is trying to hide behind the court verdict.”
This judgment has exposed the judiciary, the Federal Government of PML (N) and General Pervaz Musharraf too, who always says Pakistan first but for medical treatment Pakistan is not the first. What a ridiculous stand of Ex-Commando General now? Say the CPP Chairman in its concluding remarks.
