CPP files CMA in SC for arrest of Musharraf in High Treason case.

(ATTOCK CANTT – November 12, 2013)      Chairman Communist Party of Pakistan (CPP) Engineer Jameel Ahmad Malik today filed a Civil Misc. Application (CMA) in Supreme Court (SC) and prayed the Apex Court for immediate arrest of General Pervaz Musharraf on charge of High Treason and also for constituting of an Implementation Bench in Musharraf case as was done in NRO case so that “justice should not only be done, but should be seen to be done.”

This CMA, a copy of which is available on the party website www.cpp.net.pk is moved in the petition of CPP filed in September 2009 and others identical petitions, which the Apex Court on 3-7-2013 accepted all those petitions and directed the Federal Government to lodge a complaint of ‘High Treason’ under Article 6 of the Constitution against General Pervez Musharraf and others. 

Engineer Jameel informed the Court that nothing concrete has yet been done by the Inquiry Team even after the lapse of more than four months and the undertaking of the Prime Minister Nawaz Sharif conveyed to Court through the Attorney General (AG) of Pakistan dated 26-6-2013 was also ignored.

The AG on 26-6-2013 made a categorically  statement before the Apex Court that “in order to ensure expeditious completion of the inquiry and investigation, the Prime Minister is also considering the constitution of a Commission to oversee and monitor the progress of the proceedings.”

But surprisingly neither any Commission to oversee and monitor by the Prime Minister Sharif nor the progress of the proceedings of the case has been examined by the Prime Minister. Even the commitment of Interior Minister Chaudhry Nisar that the Inquiry under Article 6 against Musharraf would be completed within six week was not honoured.

CPP Chairman revealed in his CMA that a deal in the shape of a new NRO has already been finalized between the PMLN Federal Government and Musharraf at the behest of those hidden forces, who are in corridors of power locally and abroad and Prime Minister Nawaz Sharif has assured those forces not to proceed further for trial against Musharraf under Article 6. 

People’s Party, Tehreek-e-Insaf and other political parties in the Parliament are also not playing any concrete and positive role against the trial of Musharraf and to make the Parliament as a Supreme Body whereas the Federal Government is only empowered to make a complaint of High Treason under section 3 of High Treason (Punishment) Act, 1973 and none else.

CPP Chairman Engineer Jameel prayed the Apex Court that at this critical juncture in the history of our country and whereas to defend and protect the Constitution is the bounden duty of the Supreme Court, a time has now come where a schedule be given to the Inquiry Team of FIA to finalize the proceedings against Musharraf and others concerned in the interest of justice, the CMA concluded with these remarks.

It may be recalled that the Communist Party of Pakistan filed a petition of High Treason against General Musharraf and others in SC on 15th September, 2009 which was decided on 3rd of July, 2013.
