Communist Party of Pakistan (CPP) today challenges the newly enacted Contempt of Court Act, 2012 in the Supreme Court of Pakistan, copy of whole petition can be read at CPP website of www.cpp.net.pk
This constitutional petition of CPP was filed by its Central Chairman, Engineer Jameel Ahmad Malik under Articles 184(3) and 204 of the Constitution and seeks interpretation of Article 248 concerning the boundaries and conditions of Immunity to President, Prime Minister and others. Continue reading
Communist Party of Pakistan Chairman, Engineer Jameel Ahmad Malik commented on the sad incident of Fakhara and categorically said “neither Chief Justice of Pakistan nor Government of Pakistan or any Provincial Government is interested to solve the problems of woman. The woman in Muslim society has no right to stand up for their real rights. Even the electronic media is biased towards woman rights and they exploited the issue of Waheeda Shah un-necessary but in case of Fakhara, the whole electronic media would be silent day after tomorrow and would not now play any role in future for a poor woman Fakhara.” Continue reading
Central Chairman of the Communist Party of Pakistan (CPP), Engineer Jameel Ahmad Malik strongly objected and condemned the decision as made in the Joint Session of Parliament concerning the foreign policy.
He said he examined the report of the Parliamentary Committee on National Security (PCNS) for new terms of engagements with the United States and Nato and found no difference of policies as framed by the Army or the Parliament.
CPP leaders termed the Parliament as a rubber stamp of the top hierarchy of the Army. Continue reading

Govt employees cannot take part in politics: SC

ISLAMABAD, Nov 12: The Supreme Court has observed that a government servant is not entitled to indulge in politics when in service and upheld the dismissal of a employee of the Pakistan Ordinance Factories for indulging in politics.
Jamil Ahmad Malik, president of the POF Officers Union, was dismissed from service on the ground that while in service he indulged in politics.
Jamil Malik, who claimed to be the secretary general of the Communist Party of Pakistan, distributed on Wednesday the copies of the Supreme Court judgment in which it upheld his forced retirement. The judgment, he said, showed two sets of principles — one for the powerful, and the other for the powerless.
When asked to elaborate his assertion, he said the judiciary had allowed Chief of the Army Staff Gen Pervez Musharraf, who was a government servant, to not only indulge in politics but also to hold the office of president, while the same judiciary had punished him for taking part in politics. (ATTOCK) Communist Party of Pakistan (CPP) Chairman, Engineer Jameel Ahmad Malik has today filed an application in Supreme Court (SC) and requested the SC to hear its constitutional petition on Art 248 on the 1st of February with the on going contempt proceedings against PM Gilani.
He said that on January 19, the Special Bench of SC heard the contempt proceedings against PM Gilani and as the PM Gilani and his counsel Barrister Aitzaz Ahsan sticks to immunity plea for President Zardari and in their point of view the real issue is immunity and not contempt and so the proceedings were adjourned for 1-2-2011 to see whether the President Zardari has the immunity under Article 248 of the Constitution in NRO cases or not.
It may be recalled here that the CPP filed the petition on 13th April, 2010 which challenges and seeks interpretation of Article 248 from the Apex Court but till date this case has not been fixed for hearing. Continue reading
