Sub: COMPLAINT CODE PU251021-89248138 ON CITIZEN’S PORTAL PAKISTAN CONCERNING ABOLISHMENT OF THE ENLISTMENT IN GOVERNMENT DEPARTMENTS AS PER CHAIRMAN PEC LETTER DATED 05-09-2018 AND AS PER DIRECTION OF CHAIRMAN NAB.
COMPLAINT SUMMARY/SUBJECT:
Secretary C & W Punjab reliance on Section 6.39(iii) read with Appendix 6-A of Manual of Orders (1st Edition) and the notification dated 14.10.2013 and 11.08.2014 in favour of enlistment are in contrary and contradictory to the PEC Act, 1976 and also Article 1(2) of the Construction and Operation of Engineering Works Bye-laws, 1987 and this was all communicated to the Chief Secretary Punjab by the Chairman of the Pakistan Engineering Council (PEC) vide his letter No. PEC/Ch/03/2018 dated September 05, 2018. Even, otherwise, the instructions of Chairman National Accountability Bureau (NAB) for the complete abolishment of enlistment in all government departments for the eradication of corruption has been complied with by all the Federal Government Departments where there is no enlistment now for the Contractors and they can participate in bidding on the basis of the PEC Licence. Even the Secretary Local Government & Community Department Punjab Mr. Noor ul Amin Mengal abolished enlistment in LG&CD vide Notification No.SO.MC-Dev(LG)1-1/2020 dated 10/8/2021 and allowed the Province of Punjab based contractors/firm registered with PEC in relevant categories to participate in tendering process at the level of procurement/XENs, LG&CD, Civil Divisions in the Punjab without enlistment with LG&CD Department.
لوکل گورنمنٹ کی طرح پنجاب کے ہر محکمےمیں بشمول سی اینڈ ڈبلیو میں کرپشن کے خاتمے کے لیئےانلسٹمنٹ کی شرط فوالفورختم کریں۔
COMPLAINT DETAILS:
Dear Prime Minister of Pakistan Imran Khan Sahib! I, Engineer Jameel Ahmad Malik, Chairman Communist Party of Pakistan, Ex-President POFs Officers Association and Secretary General of Abdalians Association and Chief Executive of M/s Jamco (Pvt) Ltd have gone through the reply of the Secretary C & W Punjab dated 12/10/2021 which he has given in Complaint No. PU010921-88986773 and which reads as under:-
“Dear citizen, your complaint is reviewed and it is stated that this department enlists the A-Class contractors in different categories in accordance with the procedure mentioned in Section 6.39(iii) read with Appendix 6-A of Manual of Orders (1st Edition), 1985 on permanent basis from Category C-4 (upto rupees one hundred million) to Category C-A (No limit). The contractor/firm is required to get renewal of enlistment every year and deposit fee to the Government Exchequer as per approval granted by the Chief Minister on a summary with concurrence of Finance Department and all Engineering Departments, after which the notification dated 14.10.2013 and 11.08.2014 were issued.”
The same departmental position as enumerated by Secretary C & W Punjab was also in existence in Local Government & Community Development Department Punjab but the Secretary Mr. Noor ul Amin Mengal changed this position of enlistment and vide Notification No.SO.MC-Dev(LG)1-1/2020 dated 10/8/2021 allowed the Province of Punjab based contractors/firm registered with Pakistan Engineering Council in relevant categories to participate in tendering process at the level of procurement/Executive Engineers, LG&CD, Civil Divisions in the Punjab without enlistment with LG&CD Department with immediate effect.
محترم وزیرِاعظم پاکستان!ریاستِ مدینہ میں پنجاب کےدو محکموں میں دو متضاد فیصلے انصاف کے بنیادی اصول اورdiscriminationکے زمرے میں آتےہیں۔سیکرٹری لوکل گورنمنٹ پنجاب نورالامین مینگل نےبحیثیتِ سیکرٹری کرپشن کے خاتمے کے لیئےٹھیکوں کے لیئے بڈینگ میں حصہ لینے کے لیئے اپنےمحکمےمیں ان لسٹمنٹ کی شرط ختم کر دی ہے۔اس ضمن میں نوٹیفکیشن مورخہ 10اگست کو جاری ہو چکا ہےاورانہوں نے اپنےمحکمےمیں پاکستان انجینئرنگ کونسل کے رجسٹردشدہ تمام ٹھیکیداروں کوبغیر لوکل گورنمنٹ کےمحکمہ میں ان لسٹمنٹ کے پاکستان انجینئرنگ کونسل میں رجسٹرشدہ اپنی کٹیگری کےمطابق آزادانہ طور پر بڈینگ میں حصہ لینے کی اجازت دےدی ہےجبکہ دوسری جانب سی اینڈ ڈبلیو کے سیکرٹری نے جولوکل گورنمنٹ سے بھی کرپشن میں دس قدم آگےکامحکمہ ہے نے اپنے محکمے C&Wمیں ان لسٹمنٹ جاری رکھنے کا جو فیصلہ کیا ہے وہ اب قانونی طور پردرست نہیں ہے اور پاکستان پاکستان انجینئرنگ کونسل ایکٹ مجریہ 1976 اور آرٹیکل 1(2) آف Construction and Operation of Engineering Works Bye-laws, 1987 کی بھی صریحاََ خلاف ورزی ہے اور جوہدایات چیئرمین نیب نے سرکاری محکموں میں انلسٹمنٹ ختم کرنے کے بارے میں نوٹیفیکشن/سرکولر نکالا تھا اسکے بھی منافی ہے۔ سیکرٹری سی اینڈ ڈبلیو انلسٹمنٹ کی آڑ میں سوائے کرپشن کے اور کوئی بھی مقاصد نہیں ہیں۔
Dear PM Sahib! The decision of Secretary C&W in favour of enlistment is also hit by this principle that all the federal government departments like Pak PWD, CDA, NHA, Wapda and all others allied departments concerning with construction industry have abolished the enlistment in their departments after the direction of the Chairman NAB and now any contractors registered with PEC are allowed for bidding without enlistment in Pak PWD, NHA, CDA, Wapda and likewise other federal government departments.
Dear PM Sahib! Even, otherwise, the letter No. PEC/Ch/03/2018 dated September 05, 2018 of the Chairman PEC Engr. Jawed Salim Qureshi to the Chief Secretary, Government of the Punjab on the subject “DISCONTINUE THE PRACTICE OF ENLISTMENT WITH THE DEPARTMENTS & VIOLATIONS OF PAKISTAN ENGINEERING COUNCIL REGULATIONS ON CONSTRUCTION/OPERATION ENGINEERING SERVICES.” which reads as under:
Pakistan Engineering Council (PEC) is the only national statutory body, enacted through Act of Parliament vide PEC Act, 1976, with the mandate of regulating engineering profession. One of its major functions is to formulate and implement the rules to regulate functioning of construction industry in Pakistan by PEC Governing Body.
- In order to ensure credible professional activities in construction industry of Pakistan, PEC carries out registration of constructor/operator companies after thorough evaluation and scrutiny of their financial and professional standing. Each company so registered is characterized with a maximum allowable project value along with specific fields of engineering works it can undertake.
- As per PEC Act 1987, Article 1(2), only PEC registered companies can undertake engineering work of more than Rs. 4 Million value. The role of PEC has been endorsed by PPRA vide Public Procurement Regulation No. 3 (Annex-A). Public Accounts Committee (PAC) has all directed all the departments vide letter No.F.10(1)/2016-17/2017-PAC dated November 8, 2016 for compliance (Annex-B). However, needless to over emphasize that usefulness of any regulation is obliged to its implementation in letter and spirit. Contrarily, following has been observed:-
- While floating tenders of construction works, various departments do not impose the mandatory condition of PEC registration on the participating companies.
- A PEC registered company is asked to get itself enlisted with the tendering department, which is unnecessary and inappropriate because the company has already been registered with the PEC; the only authority competent for the purpose under the Act of Parliament.
- While floating a project, departments carry out pre-qualification of the participating companies followed by submission of Tenders Bids. The two activities done by same departments for same purpose needs to be check which is hampering the participation of bidders and transparency. The activities are not only duplication of efforts in themselves but also an overriding act on authentication awarded by PEC through registration.
- Foregoing in view, it is requested that all departments under your jurisdiction may be directed to:-
- Observe PEC registration for constructor/operator companies as a mandatory condition to participate in bidding of each project valuing more than Rs. 4 Million.
- Discontinue the practice of companies’ enlistment with the departments as a pre-condition to undertake their projects.
- Avoid pre-qualification or technical bidding as a routine practice. Any of the two said activities may be undertaken for the projects of special nature which involve special technology or particular experience.
- Being a dynamic statutory body, PEC always welcome suggestions/inputs from each and every stakeholder and responds befittingly in pragmatic and professional way. Hence, any department can communicate its suggestions/observations to PEC in order to address them through collective wisdom of a relevant and capable forum.”
Dear PM Sahib! The final authority is the Chairman PEC and not Secretary C & W concerning enlistments vides PEC Act, 1976 and Article 1(2) of the Construction and Operation of Engineering Works Bye-laws, 1987 of those contractors/firms who are registered with PEC. The Chairman PEC very rightly said to Chief Secretary Punjab vides his letter dated September 5, 2018 to “Discontinue the practice of companies’ enlistment with the departments as a pre-condition to undertake their projects.” And the Secretary LG&CD Department very rightly abolished the enlistment in his department in compliance with the Chairman PEC letter and vides the directives of the Chairman NAB as above referred.
وزیرِاعظم صاحب! سیکرٹری بلدیات پنجاب نورالامین مینگل کے اس اقدام سے پہلے اس محکمے میں اِن لسٹمنٹ کی آڑ میں بددیانت ٹھیکیداروں اور بددیانت انجینئرزاورافسروں کی ملی بھگت اور مافیاز سے کنسٹرکشن کا ایک روپے کا کام دس روپے میں ہوتا تھا جو اب ان ٹھیکیداروں میں مقابلے (competitive bidding)کی وجہ سے مناسب ریٹ پر ہونے کی توقع ہے۔
وزیراعظم پاکستان عمران خان صاحب! جب سے آپ کی حکومت آئی ہے میں مسلسل آپ سے درخواست کر رہا ہوں کہ کرپشن کے خاتمے کے لیے پنجاب کے تمام محکموں میں ان لسٹمنٹ کی شرط فوری ختم کریں مگر ابھی تک پنجاب میں صرف سیکرٹری بلدیات کے کسی نے بھی ان لسٹمنٹ ختم نہیں کی ہے۔ وزیراعظم صاحب! وجہ صاف ہے کہ محکموں کےسیکرٹریز اور چیف انجنئیرزکرپشن میں خود ملوث ہیں تو وہ کیوں کرمیری اس استدعا کو قبول کریں گے کہ ان لسٹمنٹ ختم کی جائے۔ان لسٹمنٹ ختم ہونے سے ہر محکمے میں پرچی اور پول سسٹم ختم ہو جائے گاجومحکموں کےسیکرٹریز اور چیف انجنئیرزکو منظور نہیں ہے۔جب ٹینڈرز میں پول ہو گا تو پھر یہ افسران اس ٹینڈرکومنظور کرنے کے لیےہم ٹھیکیداروں سے منہ مانگی رقم وصول کرتے ہیں۔وزیراعظم صاحب!اس لیےیہ فیصلہ آپ خود کریں اور پاکستان انجینئرنگ کونسل کے لیٹر مورخہ5ستمبر2018 اورچیئرمین نیب کی ہدایات جس کا میں نے اوپر ذکر کیا ہے اس پر من وعن عمل کرتے ہوئے ایک ایگزیکٹوآرڈر کے ذریعے چیف سیکرٹری پنجاب بشمول سیکرٹری سی اینڈ ڈبلیوپنجاب، سیکرٹری پبلک ہیلتھ انجنیئرنگ پنجاب اور سیکرٹری اریکیشن پنجاب کوہدایات جاری کریں کہ انکےمحکموں میں ان لسٹمنٹ ختم کی جاتی ہے تا کہ پاکستان انجینئرنگ کونسل میں رجسٹرشدہ اپنی کٹیگری کےمطابق آزادانہ طور پر ہر محکمے میں بڈینگ میں حصہ لے سکیں توپرچی اور پول سسٹم کا خاتمہ ممکن ہے ورنہ ان محکموں میں کرپشن ختم نہیں ہو سکتی ہےاور آپ کی حکومت اور مدینہ ریاست کا یہ نعرہ “SAY NO TO CORRUPTION” صرف ایک نعرہ ہی رہے گا۔باقی آپ اس وقت حاکمِ وقت ہیں جو فیصلہ بھی کرنا چاہیں آپ کو کوئی نہیں روک سکتا ہے اور اگر آپ ہم ٹھیکیداروں کے حق فیصلہ کرتے ہیں جو حقیقت میں ایک بہت مظلوم طبقہ ہے تو اس کے اچھے نتائج برآمد ہوں گے۔ انشاللہ۔
میری اس شکایت کی بابت بھی مجھے مطلع کیا جائےکیونکہ پچھلے دو سال سے میری اس شکایت کی عملی داد رسی نہیں ہوئی ہے۔عین نوازش ہو گی۔

میری طرف سے پاکستان انجینئرنگ کونسل کا چیئرمین منتخب ہونے پر سب سے پہلے مبارک باد قبول کیجیئے گا۔چیئرمین صاحب! آپ نے 5ستمبر 2018 کو مندرجہ بالا خط چیف سیکرٹری پنجاب کو ضرور لکھا تھا جس کی کاپی لف ہے،مگر اس کے بعد آپ نے یہ معلوم نہیں کیا کہ آپ کی ہدایات پر چیف سیکرٹری پنجاب کے ماتحت محکموں نے آپ کے خط پرعمل کرتے ہوئےمحکمانہ انلسٹمنٹ ختم کی ہے یا نہیں۔آپ کی اطلاع کے لیے عرض ہے کہ آپ کے خط مورخہ 5ستمبر 2018 پرچیف سیکرٹری پنجاب کے ماتحت محکموں نے کوئی عمل نہیں کیا ماسوائے لوکل گورنمنٹ کے اورسی اینڈ ڈبلیو،پبلک ہیلتھ انجنیئرنگ اور اریکیشن کےمحکموں میں انلسٹمنٹ اب بھی بدستورجاری وساری ہے جب کہPEC Act, 1976 اور آرٹیکل 1(2) آف Construction and Operation of Engineering Works Bye-laws, 1987 کے تحت آپ ہی قانونی طود پر مجاز اٹھارتی (competent authortity) ہیں۔لہذا میں آپ سے مودبانہ درخواست کرتا ہوں کی آپ صرف اور صرف خط لکھنے پر اکتفا نہ کریں بلکہ انلسٹمنٹ ختم ہونے کے لیے دوٹوک اور واضح حکمتِ عملی اپنائیں تاکہ ہم مظلوم ٹھیکیداربھی سکھ کا سانس لےسکیں۔

چیئرمین نیب کی ہی ایک ہدایات پرفیڈرل محکموں میں انلسٹمنٹ ختم کی گئی ہے اور اب فیڈرل کے کسی محکمے میں بھی اسلسٹمنت نہیں ہے اور ہم ٹھیکیدارپاکستان انجینئرنگ کونسل کے لائنس کی بنیاد پر ہر فیڈرل محکموں میں bidding میں حصہ لے سکتے ہیں۔آپ سے مودبانہ درخواست کی جا رہی کہ آپ کا وہ حکم جو فیڈڑل محکموں میں لاگو ہو چکا ہے اس پرپنجاب کی صوبائی حکومت کیوں نہیں عمل درآمد کر رہی ہیں؟اس کا نوٹس چیئرمین نیب صاحب ضرور لیں اورپنجاب کے محکموں میں بھی انلسٹمنٹ ختم کرنے کے لیے فوری عملی اقدامات کریں تا کہ ہم مظلوم ٹھیکیدار بھی سکھ کا سانس لےسکیں۔

میری طرف سے کنسٹرکٹرزایسوسی ایشن آف پاکستان (CAP)کا چیئرمین منتخب ہونے پر سب سے پہلے مبارک باد قبول کیجیئے گا۔بابا جی! میں آپ کو ذاتی طور پر1964سے جانتا ہوں جب آپ کیڈٹ کالج حسن ابدال میں میرے کلاس فیلو تھے۔اس وقت سے لیکر آج کے دن تک آپ کے ساتھ میرے بہت دوستانہ تعلقات ہیں اور آپ ایک اچھے، وضع داراورسلجھےہوئے انسان ہیں مگرچونکہ آپ کی کمپنی کاپاکستان کی بڑی کمپنیوں میں شمار ہوتا ہےلہذا آپ کوان محکموں میں انلسٹمنٹ کے لیے ان مشکلات سے دو چار نہیں ہونا پرتا ہےجس کا واسطہ ہم اوسط اور عام ٹھیکیداروں کو ہوتا ہے۔دوسرا معذرت سے یہ کہنے کی جسارت کر رہا ہوں کی عملی طور پر CAPنے ہم ٹھیکیداروں کے مسائل کے حل کےلیے آج تک کبھی بھی کوئی ٹھوس قدم نہیں اٹھایا ہےمگرچونکہ آپ ہمارے ذاتی دوست ہیں اس لیے میں آپ سے امید رکھتا ہوں کہ آپ اپنا ذاتی اثرورسوخ اور CAPکی طرف سے پوری کوشش کریں گے کہ ہم ٹھیکیداروں کا ان محکموں میں انلسٹمنت سے چھٹکارا حاصل ہو جائے اورہم مظلوم ٹھیکیدار بھی سکھ کا سانس لے سکیں۔
