Justice Jawwad S. Khawaja was sworn in as the 23rd Chief Justice of Pakistan on Monday August 17 to serve in the exalted position for just 23 days until his retirement on September 10, 2015.
Communist Party of Pakistan (CPP) and its Chairman Engineer Jameel Ahmad Malik firmly believe that all the Institutions of the Government like Supreme Court and others depend purely on the political system of the country and the present Supreme Court of Pakistan being part of the bourgeoisie system of our country could not play a pivotal role in providing justice to the poor and downtrodden masses of Pakistan.
Nevertheless, our party has an experience of appearing before the various Judges of the Supreme Court in Constitutional Petitions and in this context, our party Chairman Engineer Jameel Ahmad Malik has appeared daily for more than four months in one of our party High Treason case against General (Retd) Pervaz Musharraf in 2013 before the bench of Mr. Justice Jawwad S. Khawaja and our party Chairman observations about Mr. Justice Jawwad S. Khawaja are that he is very hardworking, very intelligent, very honest, upright and very bold and a Judge of highest integrity and our party congratulate and wish him the best of luck as the 23rd Chief Justice of Pakistan.
(ATTOCK – PR – AUGUST 16, 2015) Communist Party of Pakistan (CPP) and its Chairman Engineer Jameel Ahmad Malik strongly condemned the suicidal attack on the Punjab Home Minister Col (R) Shuja Khanzada and others innocent peoples today at his home in Shadi Khan near Attock City in which Col Shuja and others were martyred and several were injured.
Col Shuja was a brave son of Illaqa Chhachh and he would be remembered forever for his bravery for fighting against the religious terrorists in Chhachh and all over the country. He was a straight forward, honest and well respected politician within Chhachh and in Attock District. It is a great loss for Punjab Government and Pakistan.
Engineer Jameel expressed deep concern and sympathy with the families of Col Shuja, DSP Hazro Shaukat Shah and all others who were martyred and injured in the suicide blast.
According to reports, a jirga (open court) was underway at Khanzada’s political office in his native Shadi Khan village when the suicide attacker detonated his explosives. The blast caused the roof of the building to collapse under which the provincial home minister was trapped for several hours and ultimately martyred.
“There was between 20 and 30 people present when the blast took place,” district information officer Shahzad Niaz told Reuters. “The roof collapsed.”
DSP Hazro Shaukat Shah and other innocent’s peoples were also martyred and some were injured and taken to the nearby hospitals.
“From the evidence available, it seems that it was a suicide blast,” the CPP Chairman vehemently stressed.
Relatives and close acquaintances said Khanzada had recently been facing death threats and was usually accompanied by his security squad. However, the security squad was not with the provincial home minister today when the bomber attacked his political office near his residence.
Shuja Khanzada was given charge of the home department in Oct 2014. The home minister had recently claimed that Lashkar-e-Jhangvi’s feared leader Malik Ishaq had been taken down under the National Action Plan, a statement that seemingly went unnoticed in the press and was contradictory to the police’s statement that the dreaded terror chief and his close aides, including his two sons had been killed by firing of their own colleagues during an attempt to rescue him from police custody in Muzafffarabad last month.

(ATTOCK – PR – August 12, 2015) Communist Party of Pakistan (CPP) and its Chairman Engineer Jameel Ahmad Malik said that the Speaker National Assembly Ayyaz Sadiq exposed himself by accepting resignations of MQM immediately and not accepting the resignations of PTI.
Speaker National Assembly Ayaz Sadiq is partial and shown discrimination in dealings with the resignations of MQM and PTI. The Speaker should resign now says the CPP Chairman.
CPP says the MQM was trapped by establishment for resignations from the National Assembly, Provincial Assembly and Senate. MQM should not have resigned.
However, there is one positive aspect too that the resignations of 24 members of National Assembly, 51 members of Sindh Provincial Assembly and 8 members of Senate shows that Altaf Hussain has still full hold and control on MQM.
Farooq Sattar said that the Prime Minister made promises with MQM for formation of Monitoring Committee for Karachi operations but later PM backed out. Why it was so?
Farooq Sattar also disclosed that neither COAS General Raheel Sharif nor Core Commander Karachi met MQM leaders on their repeated written and telephonic requests which we think is against all norms of ethics and morality.

Our party Chairman Engineer Jameel Ahmad Malik has been informed officially via telephone a few minutes back that the Full Court of the Supreme Court of Pakistan would announce the judgment on our Constitutional Petition No. 6 of 2015 and other identical constitution petitions concerning military courts tomorrow on Wednesday August 5, 2015.
It may be recalled that the Communist Party of Pakistan (CPP) challenges the ‘military courts’ and 21st Constitutional and Pakistan Army Amendment Act, 2015 in the Supreme Court of Pakistan. By virtue of these amendments, the Army can trial any civilians in ‘military courts’, copy of CPP whole petition can be read at party website of www.cpp.net.pk
This constitutional petition of CPP was filed by its Central Chairman, Engineer Jameel Ahmad Malik under Articles 184(3) of the 1973 Constitution against the Federation of Pakistan, National Assembly and Senate of Pakistan praying the Apex Court to strike down these amendments.
In petition, the CPP Chairman wrote “Communist Party has bad memories about the Military Courts established during General Zia era in which our party former General Secretary Jam Saqi and other leaders of Party Prof. Jamal Naqvi, Sohail Sangi, Badar Abro, Kamal Warsi, Amar Lal and Shabir Shar was arrested and tried in a Military Court headed by Colonel Atiq Hussain on the charges of terrorism and anti-state.”
This case is also known as communist case or Jam Saqi case and during the military trial of Jami Saqi case, Engineer Jameel said “many stalwarts such as Baloch leader Mir Ghous Bux Bizenjo, Benazir Bhutto, Khan Abdul Wali Khan, Tahira Mazhar Ali Khan, Mairaj Mohammad Khan, Fatehyab Ali Khan, Maulana Shah Mohammed Amroti and among the journalists Minhaj Burna, Afzal Siddiqui, Shaikh Ali Mohammed, Shaikh Aziz, Abdul Ghani Dar, Abdullah. J Memon then commissioner and others appeared as defence witnesses but the ‘Military Court’ did not consider any evidence of the defence witnesses and sentenced Jam Saqi and all others communist leaders unlawfully and illegally for ten years.”
CPP said that the military courts would now do the same justice to the workers of religious parties and their rivals as was done with CPP in the past.
Communist Party in his petition wrote that “it was also wrong to say that the judiciary had failed because they had handed down convictions to nearly 8,000 death row prisoners and that it was not the judiciary’s fault, if these sentences were not carried out and the rulers themselves did not execute the condemned criminals on the pressure of the USA, the European Union (EU) and the greed for dollars.”
In the petition, the Communist Party has prayed the Supreme Court to set aside the 21st Constitutional Amendment and Pakistan Army Amendment Act, 2015 as these amendments are against the basic features and structure of 1973 Constitution and also against the Fundamental Rights of Articles 8, 9, 10, 10A, 14, 17, 19 and 25 whereas these amendments are also in violations to Articles 2A, 4, 5, 6, 175 and 190 of 1973 Constitution and runs parallel to the existing judicial system.
The parliamentarians even bypass and ignore the Supreme Court judgment as given in Mehram Ali v. The Federation (PLD 1998 SC 1445) and Liaquat Hussain Case (PLD 1999 SC 504) which declared the Military Courts as un-constitutional.
The Parliament and Senate while passing the 21st Constitutional and Army Amendment Act, 2015 has not only undermined the parliament, democracy and judiciary but has also curbed, curtailed and infringes the fundamental rights of citizen and the fair trial and due process of law of Court under Article 10A has also now been jeopardized.
Engineer Jameel said and stressed in his petition that any Parliament do have a right to amend the Constitution and make law but the Parliament cannot amend the basic doctrine of Constitution vide held in judgment WUKALA MAHAZ BARAI TAHAFAZ DASTOOR versus Federation of Pakistan (PLD 1998 SC 1263) and also cannot enact any law, which curbs, curtails and infringes the fundamental rights of the citizens.
13 questions of law point have been raised in the petition. The foremost questions in this petition are whether the Parliament is empowered to amend the constitution against the basic structure and can enact any law which infringes the fundamental rights of citizens as given in Articles 8, 9, 10, 10A, 14, 17, 19 and 25 and can also curtail the powers of the Independence of Judiciary as enshrined in Articles 2A, 175 and 190 of 1973 Constitution.
In petitioner opinion “The Supreme Court has all the powers to examine whether any constitutional amendment has been made in line with the basic scheme or totality of the Constitution or not,” just in a way the Indian Supreme Court had struck down some Articles of the Indian Constitution by introducing the “principle of basic structure of the Constitution”.
These amendments fully curtail the freedom of speech and freedom of the press as enshrined in Article 19 of the 1973 Constitution as now after these amendments, the print and electronic media are barred to write and broadcast or air any news or to telecast any interview concerning the Talibans and terrorists during their trial in the military courts in contrary to the Article 19 which allows the freedom of speech and freedom of the press.
It is now open secret that the Prime Minister Nawaz Sharif, his PMLN and its allied parties in the parliament and other bourgeoisie political and religious parties in parliament voted for ‘military courts’ under the fear and pressure from the Army.
The parliamentarian this act is a severe violation of the oath taken by them to protect, safeguard and defend the Constitution of Pakistan. The justice demands that all these parliamentarians who voted for ‘military courts’ should be put to trial under Article 6 of the Constitution.
The leaders of Jamaat-e-Islami and the Communist Party of Pakistan (CPP) have said that the anti Pakistan statements of MQM chief Altaf Hussain have proved that his party belongs to Indian secret agency RAW and is an enemy of Pakistan.
JI Punjab Ameer Dr Wasim Akhtar said, “Altaf Hussain’s statements and speeches against Pakistan, its Army and other departments proved his treason to the country. As long as the government does not ban his speeches and put an end to the MQM’s extortion culture, target killing cannot be stopped,” he said.
For the last 27 years, the MQM has made the City of Lights a place of darkness. He said that one British citizen was continuously threatening Pakistan and its armed forces and other departments and now there is a need that Prime Minister Nawaz Sharif should take this issue with British government directly in accordance with the Article 6 of the Constitution. He also demanded that the MQM’s leader should be arrested through Interpol and brought to Pakistan.
He said that Altaf Hussain’s statement was an attack on Pakistan’s sovereignty which should not be neglected. Karachi Operation should continue until the last terrorist is arrested; the whole world knows that in operation on Nine-Zero, fugitive target killers, extorters and other criminals involved in serious crimes were arrested. Upon recovering of NATO’s stolen weapons from Nine-Zero, Babar Ghauri should be included in the investigation, he demanded.
This is the need of time that enemies of the state hiding under the cover of Altaf Hussain and MQM should be brought to justice and strict action be taken against them so that peace can be restored in Karachi, he said. Likewise, Communist Party of Pakistan (CPP) Chairman Jameel Ahmad condemned the Altaf Hussain’s statement inviting NATO forces to come to Pakistan and launch an operation against the sovereignty and integrity of the country.
He said that his address to the MQM’s Annual Convention in the US city of Dallas via telephone is tantamount to waging war against the country and the purpose of such a speech was to bring a bad name to Pakistan and its all institutions. The CPP chairman said that the sarcastic poems were also read against the armed forces of Pakistan and accusations were leveled against the army at the time when the Army is under the command of Chief of Army Staff General Raheel Sharif are fighting against terrorists and doing their duties as per the Constitution of Pakistan.
“Altaf’s hate-inciting speeches made from London have crossed limits of all the principles, laws and regulations and the demand for a separate province for Mohajirs is also not justified. The speeches made from MQM’s London Office from time to time are conspiracy against the sovereignty and integrity of our country, as he invited foreign forces and India to interfere in Pakistan’s internal matters,” he said.
Altaf Hussain is not in senses as the noose around him is being tightened over Dr Imran Farooq murder case and the money-laundering case filed in London, he said and added that in frustration, he is venting his anger on Pakistan.

His statement while addressing the MQM’s Annual Convention in the US city of Dallas via telephone tantamount to waging war against our country and the purpose of such a speech was to bring a bad name to Pakistan and its all institutions.
CPP Chairman Engineer Jameel said that the sarcastic poems were also read against the armed forces of Pakistan and accusations were leveled against the army at the time when our Army under the command of the Chief of Army Staff General Raheel Sharif are fighting against the Taliban, religious fundamentalists and terrorists and are doing their duties as per Constitution of Pakistan, 1973.
Altaf’s hate-inciting speeches made from London have crossed limits of all the principles, laws and regulations and the demand for a separate province for Mohajirs is also not justified.
